Drug Offences 

 

Drug offences are taken very seriously in Ireland, and even minor drug possession convictions can have severe career consequences. At Green & Associates Solicitors, we have extensive experience defending individuals accused of drug-related crimes, including possession, intent to distribute, and importation.


Under Section 4 of the Criminal Justice (Public Order) Act 1994, being intoxicated in a public place is an offence. While the maximum penalty is a class E fine, the Gardai have the authority to seize any intoxicating substances if they suspect an offence is occurring.

 



 

Threatening, Abusive, or Insulting Behaviour in a Public Place

Section 6 of the Criminal Justice (Public Order) Act 1994 makes it an offence to use threatening, abusive, or insulting words or behaviour in a public place with the intent to cause a breach of the peace. This includes actions likely to provoke a fight or aggressive behavior from groups. A person found guilty may face a class D fine and a maximum prison sentence of 3 months. The Garda can also confiscate alcohol.


Disorderly Conduct in a Public Place

Section 5(i) of the Act defines "offensive conduct" as unreasonable behaviour likely to cause serious annoyance. This offence applies between midnight and 7 a.m., or at any time after being asked by the Garda to desist. The penalty is a class D fine. Additionally, Section 23A allows the Garda to impose a fixed charge fine of €140 for disorderly conduct, avoiding court proceedings if certain conditions are met.


Distribution or Display of Offensive Material

It is an offence to distribute or display threatening, abusive, insulting, or obscene material in a public place with intent to provoke a breach of the peace or recklessness regarding such a violation. The penalty for this offence can include a fine of up to €500 or imprisonment for up to 3 months.


Wilful Obstruction

Under Section 11, anyone who unlawfully obstructs or interrupts the free passage of persons or vehicles in a public place may face a fine of up to €200.


Entering a Building with Intent to Commit an Offence

Section 13 prohibits entering a building or its curtilage as a trespasser with the intent to commit an offence. A person guilty of this may face a fine of up to €1,000 or imprisonment for up to 6 months.


Trespass on a Building

It is an offence to trespass on a building or its curtilage without reasonable excuse in a manner that causes fear to another person.


Riot

Section 14 defines a riot as 12 or more persons using or threatening unlawful violence for a common purpose, causing reasonable fear for safety.


Violent Disorder

Under Section 15, three or more persons using or threatening unlawful violence can also be charged if their conduct would cause reasonable fear for safety to others present.
