Drug Driving in Cork: Understanding the Test Procedure and Law

Driving under the influence of drugs poses a significant risk on Irish roads. Recent legislation has strengthened Garda enforcement capabilities, with roadside drug testing becoming a reality for motorists in Cork.

This article explores the current legal landscape surrounding drug driving in Cork, outlining the test procedure, key legal considerations, and when to seek legal advice.

The Rise of Roadside Drug Testing

Before April 2017, Gardai relied on evidence of driver impairment to prosecute drug driving offences. This often involved a combination of observations, witness statements, and blood tests. The introduction of roadside drug testing using oral fluid swabs streamlined the process and removed the need to demonstrate impairment.

The case of DPP v O’Leary (2018) played a crucial role in clarifying the legal framework for drug driving offences.

In this case, the High Court upheld the constitutionality of roadside drug testing and the zero-tolerance approach for specific drugs like cannabis and cocaine. The court determined that the presence of these substances above a specified limit constitutes a crime, regardless of any observed impairment. Furthermore, a delay of 10 minutes should have been taken to ensure that the roadside test was not contaminated and valid as per guidance instructions from the manufacturer manual.

The roadside testing procedure

Gardaí in Cork are now equipped to conduct roadside drug tests. The procedure typically involves the following steps:

  1. Observation: If a Garda suspects a driver is under the influence of drugs based on driving behaviour or other observations, they can pull the vehicle over.
  2. Preliminary inquiry: The Garda will explain the suspicion and request the driver to participate in a roadside drug test. It’s important to note that this is a voluntary test, but refusal can raise further suspicion and potentially lead to a station-based drug test.
  3. Oral fluid swab test: If the driver consents, a Garda will administer a mouth swab test using a device approved by the Minister      for Transport. The swab takes a sample of saliva for analysis. The Drager Drug Trust 5000 is similar to an antigen test in how  the procedure is performed, and a ten-minute observation time of the alleged driver must be carried out to ensure the test is performed as per manufacturer instructions. The Securitec drug wipe 6s is the news system used since early 2023. If someone has used mouthwash brushed teeth eaten food or drunk liquid this can render the tests authenticity as erroneous and void. The test must be operated at correct temperature. For accuracy, the saliva must be free from extraneous bodies. Professor John Cusack, professor of the Medical Bureau of Road Safety, said the test works like an antigen test and is more portable and faster than other models. Unlike its predecessor, it can test for amphetamines and methamphetamines alongside cocaine, cannabis, benzodiazepines and opiates.
  4. Screening results:  The device provides an immediate preliminary indication of the presence of specific drugs, including cannabis and cocaine.
  5. Arrest and station test: A positive roadside test result can lead to arrest and a further drug test at a Garda station. This more comprehensive test, often      involving blood or urine samples, provides a definitive result for evidential purposes in court.

Legal considerations and potential defences

While the roadside test simplifies enforcement, it’s crucial to understand that legal challenges can arise. Here are some key considerations:

Accuracy of the roadside test: The roadside devices are designed for preliminary screening, and their accuracy can be challenged. Calibration records and proper administration of the test become vital in court.

Medical conditions: Certain prescribed medications can trigger a positive result. If you have a legitimate medical reason for the presence of a drug, presenting a valid prescription can constitute a defence.

Chain of custody: Strict protocols govern the handling and storage of samples taken at the station. Any errors in this process could lead to the evidence being excluded from court.

Driving impairment: While zero tolerance applies to specific drugs, for others, the prosecution must still prove impairment. In such cases, evidence of driving behaviour and observations become crucial.

Additional considerations

Disqualification and penalty: A conviction for drug driving can result in significant driving disqualification, a hefty fine, and even a custodial sentence in severe cases. The specific penalty will depend on the severity of the offence and past driving convictions.

Insurance implications: A drug driving conviction impacts your car insurance premiums. Drivers with a drug driving offence on their record may face difficulty obtaining affordable car insurance, or their premiums may increase dramatically.

Impact on employment: Depending on your profession, a drug-driving conviction has repercussions on your employment. Consider how such a charge might affect your job security and future career prospects.
