FAMILY

 Family law in Ireland governs legal matters related to family relationships, including marriage, divorce, child custody, adoption, and domestic violence. The main legislation governing family law in Ireland is the Family Law Act 1995, the Guardianship of Infants Act 1964, the Status of Children Act 1987, and the Domestic Violence Act 2018, among others.  


Here are some key areas of family law in Ireland:  

 Marriage

 Irish law recognises both civil and religious marriages. A registrar conducts civil marriages, while religious marriages require the presence of a registered solemnizer. Marriages must be registered with the General Register Office.

  

Divorce

 Divorce in Ireland is governed by the Family Law Act 1995. To obtain a divorce, a couple must be married for at least four years and demonstrate that the marriage has irretrievably broken down. Divorce proceedings are typically held in the Circuit Court or the High Court.


  

Child Custody and Guardianship

The Guardianship of Infants Act 1964 establishes the legal framework for the rights and responsibilities of parents in relation to their children. It covers issues such as custody, access, and maintenance. Unmarried fathers can acquire guardianship rights by agreement with the mother or through a court order.


 Adoption

 Adoption in Ireland is regulated by the Adoption Act 2010. It provides a legal process for individuals or couples to adopt a child and establishes the Adoption Authority of Ireland as the central authority responsible for overseeing adoption services. 

 

Domestic Violence

 The Domestic Violence Act 2018 addresses domestic violence issues in Ireland. It provides legal protection for victims of domestic violence and allows courts to grant various protection orders, including safety orders, barring orders, and emergency barring orders.  It's important to note that family law can be complex, and it's advisable to seek legal advice from a qualified family law practitioner if you have specific questions or require assistance with a family law matter in Ireland.
